Legal basis of the processing
Art. 6 para. 1, sentence 1 lit. a GDPR serves our company as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, when processing operations are necessary for the supply of goods or to provide any other service or consideration, the processing is based on Article 6(1)(b) GDPR. The same applies to such processing operations that are necessary for the implementation of pre-contractual measures, for example in cases of inquiries about our products or services. If our company is subject to a legal obligation that requires the processing of personal data, such as for the fulfillment of tax obligations, the processing is based on Art. 6 para. 1 lit. c GDPR.  in accordance with Art. 16 GDPR to immediately request the correction of incorrect or incomplete personal data stored by us;
 in accordance with Art. 17 GDPR to request the erasure of your personal data stored by us, unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims;
 in accordance with Art. 18 GDPR to demand the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to delete it and we no longer need the data, but you need it to assert, exercise or defend legal claims or you have objected to the processing in accordance with Art. 21 GDPR;

Handling applicant data

We offer you the opportunity to apply to us via various channels (e.g. by email, post, online application form or WhatsApp). In the following, we inform you about the scope, purpose and use of your personal data collected as part of the application process.

Scope and purpose of data collection

If you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during job interviews, etc.) insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b GDPR (general contract initiation) and – if you have given your consent – Art. 6 para. 1 lit. a GDPR. Consent can be revoked at any time with effect for the future.

If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of § 26 BDSG and Art. 6 para. 1 lit. b GDPR for the purpose of implementing the employment relationship.

Data retention period

If we are unable to make you a job offer, you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6 para. 1 lit. f GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. The retention serves in particular as evidence in the event of a legal dispute. If it is apparent that the data will be required after the six-month period has expired (e.g. due to an impending or pending legal dispute), the data will only be deleted when the purpose for further storage no longer applies.

Data may also be stored for longer if you have given your consent (Art. 6 para. 1 lit. a GDPR) or if statutory retention obligations prevent deletion.

Inclusion in the applicant pool

If we are currently unable to make you a job offer, you may be able to join our applicant pool. If you are accepted, all documents and details from your application will be transferred to the applicant pool so that you can be contacted in the event of suitable vacancies.

Inclusion in the applicant pool is based exclusively on your express consent (Art. 6 para. 1 lit. a GDPR). Giving your consent is voluntary and is not related to the current application process. You can revoke your consent at any time, in which case the data will be irrevocably deleted from the applicant pool, provided there are no legal reasons for storage.

We will irrevocably delete the data from the applicant pool no later than 18 months after consent has been granted.

Application via messenger service WhatsApp

We inform you below about the processing of your personal data if you use the option of transmitting your applicant data and documents via WhatsApp.

WhatsApp generally stores and transmits your data in encrypted form; however, the following so-called metadata is stored in unencrypted form:

  • Telephone number,
  • Location,
  • IP address,
  • Device information,
  • the type and frequency of app use

Legal basis for data processing

The permissibility of data processing is generally based on your consent in accordance with the European General Data Protection Regulation (GDPR), Art. 6 para. 1 lit. a). Your data may also be forwarded by WhatsApp to other companies of the META Group and other subcontractors. In order to ensure the permissibility of data processing in accordance with applicable law, we have concluded an order processing contract with WhatsApp. Any data transfers to a third country (e.g. the USA) are always carried out in accordance with the provisions of the European standard contractual clauses that are applied between the partners involved.

If you use WhatsApp for your application process at our company, you can determine the storage period of your data at WhatsApp yourself. If you do not make use of this option, it is ensured in any case that your applicant data will not be stored indefinitely by WhatsApp or another company cooperating with WhatsApp in the USA or another third country.

You can revoke your consent to data processing by WhatsApp at any time with effect for the future. To do so, please contact our company or our data protection officer.
